New Message: Comments bug?

When NOT logged in to a site and trying to post a comment it says you need to be a member etc. in the Comments box. Adding E-Mail and password then the comment and clicking submit results in

403 Forbidden
Request Forbidden.

But if I log on to the site first and then post a comment, it goes through to the 'pending' page fine.
